Terms of Service
1. Who we are
The Tell is operated by APEX SOLUTIONS EOOD, a company registered in Bulgaria under company number 207775650, VAT number BG207775650, with its registered address at 67 Vitosha Blvd., office 4, 1000 Sofia, Bulgaria (“The Tell”, “we”, “us”). You can contact us at care@thetell.life.
We are the seller of every purchase. Payments are processed by our payment provider, Stripe; we do not receive your full card details. These Terms govern your use of The Tell website, the free preview, and the report service.
2. The service
The Tell creates a personalized digital report — which we also call a “portrait” — from birth date information submitted for an adult. A shorter free “preview” may also be offered. In these Terms, “report” includes the portrait and, where relevant, the preview.
Reports are created automatically using our proprietary interpretive method and automated tools, including artificial intelligence. Reports are not individually reviewed by a person before delivery. They are designed for personal reflection and entertainment. A report is not a scientific or clinically validated assessment, a statement of fact about any person, a diagnosis, a prediction, or professional advice.
Because reports are generated automatically, a report may contain statements that are general, inaccurate, incomplete, or that do not apply to you, and different reports may share similar themes or wording. Our proprietary method, prompts, and internal systems are confidential. This does not restrict disclosures required by law or your rights to information about the processing of your personal data.
The paid report is a one-time purchase. It is not a subscription. The price shown at checkout is the total you pay; no taxes or fees are added to it. We may change prices and product features at any time, but a change does not affect an order already paid for.
3. Eligibility
You must be at least 18 years old and legally able to enter into a contract. Every person whose information you submit must also be at least 18. You may not submit information that you know or reasonably believe relates to a minor.
The Tell is currently not available in the United Kingdom or in the US states of Washington and Nevada. We check availability from the approximate location of your IP address before a preview or an order; attempts to evade a geographic restriction are prohibited. We may decline or cancel any order before generation begins, in which case any payment taken is refunded in full.
4. Reports about another adult
At launch, previews and portraits are available only about yourself. Do not submit another person’s birth date. Reports about another adult will become available only when that option is expressly enabled, and this Section then applies.
Where this option is offered and you request a report about another adult, you represent that:
- you have a lawful personal or household reason to provide the information;
- the person is at least 18;
- you will use the report privately, responsibly, and only for personal reflection;
- you will not present or distribute it as an objective statement of fact about that person; and
- you did not obtain or submit the information unlawfully and your use will not violate confidentiality, a protective order, or another person’s rights.
Where applicable, you must make the notice we provide for that person available to them. Your statements do not replace The Tell’s own privacy obligations. You are responsible for your use of any report you request about another person.
5. Responsible use
You must not use The Tell or a report:
- to make or support a decision about another person’s employment, credit or lending, housing, insurance, education admission, healthcare, legal rights, immigration, public benefits, or any other matter that may have a legal or similarly significant effect;
- as a diagnosis, professional assessment, background check, or factual proof of any person’s health, mental state, personality, identity, honesty, compatibility, risk, or future behavior;
- to stalk, harass, coerce, discriminate against, surveil, blackmail, impersonate, publicly shame, or otherwise harm another person;
- to create, publish, sell, or contribute to a dossier, searchable database, or data-broker profile about another person; or
- for any unlawful purpose.
A report about another adult is intended to help you reflect on your own perspective and relationship. It is not an objective assessment of that person.
We may refuse, suspend, or cancel an order, or disable access to a report, where we reasonably believe it is connected with a prohibited use. We may preserve or disclose limited records where required by law or reasonably necessary to protect people, investigate abuse, or secure the service.
6. Your wellbeing
Reports may touch on personal subjects such as relationships, emotions, work, and money. The Tell is not a crisis, counseling, or support service. If you are in distress or thinking about harming yourself, contact local emergency services or, in the United States, call or text 988 (Suicide & Crisis Lifeline).
7. The free preview
The free preview is a short sample offered at our discretion and shown on screen, usually within a minute. It is provided without charge and “as is”, may differ in length, depth, and content from the paid report, and may be changed, limited, or withdrawn at any time. A preview does not create an obligation to buy, and buying the full report does not guarantee that it will resemble the preview. Sections 5, 10, 13, and 14 apply to the preview.
8. Ordering and delivery
You must check the birth date, the name on the report, and the email address before payment; we generate the report from the details you submit. Generation starts after confirmed payment. The report is normally ready within ten minutes, but it may occasionally take longer. We deliver it to the buyer through a secure download link sent to the email address provided at checkout. Keep the link and the report confidential. Download and keep your PDF: online access is available for up to 24 months after delivery, subject to earlier deletion at your request or lawful suspension. We do not provide permanent online storage.
An order confirmation or payment authorization is not a promise that generation cannot fail. If we cannot complete an order, we will correct it or refund it as described in Section 10.
9. Immediate generation and statutory cancellation rights
We begin creating your personalized digital report after payment is confirmed. Any statutory cooling-off, withdrawal, or cancellation right that applies to your purchase remains available unless all legal requirements for its loss have been met. Accepting these Terms or making payment does not, by itself, waive such a right. Contact care@thetell.life to exercise an applicable right. Section 10 does not limit it.
10. Errors, non-delivery, refunds, and statutory remedies
If a report is not delivered, is technically corrupted, or materially differs from the submitted order because of our error, contact care@thetell.life. We aim to investigate and provide a corrected report or working access within 24 hours. If we cannot supply a usable report within a reasonable time, we will refund the full price. For defects, we may first correct or replace the report where applicable law permits. Mandatory consumer remedies remain available.
Because every report is created to order, we do not offer refunds for a change of mind, for interpretive disagreement, or because a report does not feel personally accurate or resonant, once the report has been validly supplied. An error in details you submitted (such as a mistyped birth date) is not our error; we may, at our discretion, offer a corrected report. This section does not limit mandatory rights concerning conformity, supply, deceptive descriptions, or other consumer protection.
We make refunds through the original payment method; they may take the payment network’s processing time.
Please contact us before disputing a charge with your bank; most problems are resolved faster that way. If a payment is reversed or charged back, we may disable access to the related report while the dispute is open, without affecting any rights you have under law.
11. Intellectual property and service misuse
The Tell service, design, software, method, templates, editorial system, and branding are owned by us or our licensors. Subject to these Terms and payment, you receive a personal, non-exclusive, non-transferable license to keep and use the delivered report for private, non-commercial purposes.
You may share your own self-report privately. You must not publicly post, sell, sublicense, or commercially exploit a report about another person, or any report at scale. You may not remove legal notices or use The Tell branding to imply endorsement.
Unless the law expressly allows it, you must not copy or scrape the service at scale, reverse engineer it or attempt to extract or reconstruct its method, prompts, or underlying systems, use The Tell content or reports to train or improve an artificial intelligence model, bypass security, age, geographic, payment, or usage controls, or interfere with the service or another person’s use of it.
You give us permission to use the information you submit to create, deliver, and support your report, and to operate, secure, and improve the service as described in the Privacy Policy.
12. Privacy
Our Privacy Policy explains how we process buyer and report-subject information, including automated generation, service providers, international transfers, retention, and rights. A report may constitute personal data about its subject. You must protect it accordingly.
13. Disclaimers
The Tell is provided for personal reflection and entertainment. Reports are interpretive, and different readers may experience them differently. They are not a substitute for qualified medical, mental-health, legal, financial, or other professional advice. Do not rely on a report for a significant real-world decision.
To the maximum extent permitted by law, the service and reports are provided “as is” and “as available”, and we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that a report will be accurate, complete, or meet your expectations, or that the service will be uninterrupted or error-free. We do not exclude any warranty, remedy, or liability that cannot lawfully be excluded, including mandatory consumer rights and liability for fraud.
14. Limitation of liability
To the maximum extent permitted by law: (a) we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or emotional distress, arising from or related to the service or any report, including any decision you make or action you take based on a report; and (b) our total liability arising from or related to the service or any order will not exceed the amount you paid for that order or, if you paid nothing, USD 50.
These limits apply whatever the legal theory and even if we were told the damage was possible. They do not apply where a higher liability or remedy is required by law, including liability for death or personal injury caused by negligence, for fraud, or for gross negligence or willful misconduct where the law does not permit it to be limited.
15. Indemnity
To the extent permitted by law, you will indemnify and hold us harmless from third-party claims, losses, and reasonable legal costs arising from your breach of Sections 4, 5, or 11, including your use or distribution of a report about another person. This does not apply to consumers where such an obligation is not permitted, and it does not apply to the extent a claim is caused by our own breach.
Claims must be brought within the limitation periods provided by applicable law.
16. Changes, availability, and termination
We may update, secure, or discontinue features prospectively. A change will not reduce rights already attached to a paid order. We may change these Terms for future use; material changes take effect only after notice and the effective date shown in the updated version, and the version you accepted at checkout continues to govern that order.
We may suspend or end access to the service for a breach of these Terms. Sections 4, 5, and 11 through 17 survive the end of your use of the service.
17. Governing law and general terms
These Terms are governed by Bulgarian law. If you are a consumer, this choice does not deprive you of the mandatory protections of the country or state where you habitually reside, and courts with mandatory consumer jurisdiction remain available. Otherwise, the courts of Sofia, Bulgaria have jurisdiction.
These Terms, the checkout disclosures, and the Privacy Policy form the entire agreement applicable to the order. If a provision is unenforceable, the remaining provisions continue to apply. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms; we may transfer ours in connection with a reorganization, merger, or sale of the business, without reducing your rights. We are not responsible for delay or failure caused by events beyond our reasonable control. You agree that we may provide notices and records electronically. If these Terms are translated, the English version controls to the extent permitted by law.
